Man who raped his arranged marriage bride for five months and referred to her as 'my property' is given four more years jail after his appeal against his conviction spectacularly backfired

A man who repeatedly raped his new bride has seen his jail sentence increased by four years following a failed court appeal.

The man, known only by the pseudonym Jayadev Patil, was convicted of 10 rape charges, two of assault and one of threatening to kill the woman, who he described as 'my property' after their 2015 wedding.

Patil appealed his multiple convictions, with a lawyer questioning what on earth the jury was thinking in finding him guilty of those offences but not guilty of others.

He was originally sentenced to nine years and seven months behind bars.

But three appeal judges elected to increase that sentence to 14 years, ordering him to serve at least 10-and-a-half years before he is eligible for parole.

Patil and the woman had met only once, the day before their February 2015 arranged marriage.

He was acquitted of raping the woman on their wedding night, but convicted of a series of rapes beginning just days later.

On the first occasion he held her by the throat against a wall and raped her while telling her she should 'listen and obey' him.

Patil threatened to kill the woman and then raped her after she returned from seeing her family overseas. He was angry and claimed the woman had stayed abroad longer than she had given him permission for.

Multiple times before attacking her, he told the woman 'I'll show you what you are worth' and 'I think I need to show you your worth again'.

The woman fled interstate after a violent incident in August 2015 when Patil became incensed that she had told others how he treated her.

He beat her, bit her, raped her and left her naked outside for 45 minutes.

The appeal judges found the individual rape sentences were manifestly inadequate and 'simply do not reflect the seriousness of the offending'.

They also questioned comments and further investigations made by the County Court sentencing judge, Michael McInerney.

McInerney undertook his own investigations and noted in handing down his sentence that it's not possible in India to secure a conviction for rape in marriage.

It's not clear why he thought that was necessary to investigate or comment on, the judges found.

They also noted McInerney's comment that it was 'impossible' to reconcile the evidence that Patil was a 'harsh and brutal husband' with comments in nine supporting references given to the court by his supporters.

Patil will be deported on his release.
